Most analytic epistemologists, foundationalists and coherentists alike, have rejected the possibility of an infinitely long, non-recurring regress of justified beliefs. it is instructive to inquire why this notion has received nearly universal condemnation. in a review of recent work six sorts of arguments against infinite justificatory chains are examined. it is concluded firstly that, while regresses in which each belief is justified solely via relations to further beliefs cannot exist, the impossiblity of other sorts of infinite justificatory chains has not (...) been shown, and secondly that there may nevertheless be sound methodological reasons for provisionally rejecting the infinite regress possibility while more satisfactory alternatives are explored. Catholics and libertarians make strange bedfellows. They sharply disagree on many issues. However, when it comes to intellectual property rights, they are surprisingly congruent, albeit for different reasons. The present paper traces out the agreement on patents between these two very different philosophies.

We present a cross-sectional study of ethical decision-making correlated with spirituality and utilizing moral intensity as a moderator for workers in the Southeastern United States. This study presents spirituality as an individual variable and moral intensity as a situational variable along with ethical decision-making to examine the interaction of these factors in moral dilemmas. Utilizing previously validated instruments for ethical decision-making and individual spirituality, we find that workers with relatively high measured spirituality made less ethical decisions compared to workers with (...) relatively lower measures of spirituality. Further, we find that the introduction of high moral intensity as a situational variable does not moderate the observed correlation between spirituality and ethical decision-making. This research supports the conceptual nature of the Interactionist Theory by presenting in a single study both individual and situational variables in ethical decision-making. (shrink)

Christopher D. Stone has claimed that natural objects can and should have rights. I accept Stone’s premise that the possession of rights is tied to the possession of interests; however, I argue that the concept of a natural object needs a more careful analysis than is given by Stone. Not everything that Stone calls a natural object is an object “naturally.” Some must be taken as artificial rather than as natural. Thistype of object cannot be said to have intrinsic interests (...) and hence cannot be given rights that can protect “its own sake”-which is the sort of right that Stone focuses on. Further, there are other sorts of natural objects which, although they are objects “naturally,” cannot meaningfully be said to have intrinsic interests, and thus cannot have the sorts of rights that Stone is concerned with. Finally, there are other sorts of natural objects which are objects naturally and which have intrinsic interests, but which are not proper candidates for the possession of rights. The prerequisites for being “owed” rights are the possession of intrinsic interests and the capability to suffer when those interests are interfered with or denied or threatened. (shrink)

Nucleation and motion of kink pairs on partial dislocations are examined by elasticity theory for materials with a high Peierls stress. Two approaches are used: one considers the change in average stacking-fault energy due to alloying elements and the other considers the change in local SFE due to a nearby solute atom. Both approaches highlight the role of SFE on kink nucleation, propagation and annihilation and both furnish strain rate as a function of stress, temperature and SFE. Model predictions are (...) compared with yield stress data for two systems: firstly, an intermetallic, MoSi 2 , which softens for alloying elements that decrease the SFE and hardens for Re additions that increase the SFE; secondly, a ceramic oxide, MgO-Al 2 O 3 spinel, which softens with increasing addition of excess alumina and at the same time exhibits a decrease in SFE. The average SFE approach agrees qualitatively with the data while quantitative agreement is obtained with the local SFE approach. The possibility is considered that the model applies to other materials, such as TiAl, HfV 2 and Fe 3 Al, which show softening with certain alloying additions. One requirement is that the dislocations are dissociated more than a few atomic distances; otherwise kink nucleation occurs on the perfect dislocation . Hence the model does not apply to materials such as bcc metals which only have a core dissociation. Normal hardening effects of solutes from size and modulus misfits are additive with any softening effects from a decrease in SFE and so may mask the latter, as occurs for W additions to MoSi 2. This collection of essays aims to mark a place for American philosophy as it moves into the twenty-first century. Taking their cue from the work of Peirce, James, Santayana, Dewey, Mead, Buchler, and others, the contributors assess and employ philosophy as an activity taking place within experience and culture. Within the broad background of the American tradition, the essays reveal a variety of approaches to the transition in which American philosophy is currently engaged. Some of the pieces argue from an (...) historical dialogue with the tradition, some are more polemically involved with American philosophy’s current status among the contemporary philosophical "schools," and still others seek to reveal the possibilities for the future of American philosophy. In thus addressing past, present, and future, the pieces, taken together, outline a trajectory for American philosophy that reinvents its importance from a new angle of vision. (shrink)

Participants were asked to draw inferences about correlation from single x,y observations. In Experiment 1 statistically sophisticated participants were given the univariate characteristics of distributions of x and y and asked to infer whether a single x, y observation came from a correlated or an uncorrelated population. In Experiment 2, students with a variety of statistical backgrounds assigned posterior probabilities to five possible populations based on single x, y observations, again given knowledge of the univariate statistics. In Experiment 3, statistically (...) naïve participants were given a problem analogous to that given in Experiment 1, framed verbally. Experiment 4 replicated Experiment 3 but added an “impossible to determine” response option. Models that rely on computing sample correlations make no predictions about these investigations. From a Bayesian perspective, participants’ inferences in all four experiments tended to make probabilistically valid inferences as long as the single datum was directional. The results are discussed in light of the Brunswikian notion of vicarious functioning. (shrink)

Background Institutional Review Boards (IRBs) are federally mandated to include both nonscientific and unaffiliated representatives in their membership. Despite this, there is no guidance or policy on the selection of unaffiliated or non-scientist members and reports indicate a lack of clarity regarding members’ roles. In the present study we sought to explore processes of recruitment, training, and the perceived roles for unaffiliated and non-scientist members of IRBs.Methods We distributed a self-administered REDCap survey of members of the Association for the Accreditation (...) of Human Research Protection Programs familiar with IRB member recruitment. The survey included closed and open-ended questions regarding: the operation of the HRPP/IRB(s), how unaffiliated and non-scientist members are recruited, whether they had faced challenges recruiting for these roles, and training and mentorship offered. The survey also collected information regarding the perceived value and roles of unaffiliated and non-scientist members.Results 76 responses were included in the analysis (38% completion rate). The most common approach for recruitment was referral from current IRB members, with almost half of respondents indicating challenges recruiting unaffiliated members. Over 75% indicated no additional training was provided to unaffiliated or non-scientist members compared to affiliated or scientist members. Most common supports provided were travel/parking expenses and honoraria. Commonly perceived roles were to provide an independent voice from the participant perspective, notably regarding consent processes and materials.Conclusions Respondents indicated challenges in defining unaffiliated and non-scientist members and limited practices toward recruitment and support. Future work should more closely examine the challenges in defining these roles and applying the definitions in practice, as well as strategies that may improve recruitment and retention of unaffiliated and non-scientist members. State Medical Boards (SMBs) can take severe disciplinary actions (e.g., license revocation or suspension) against physicians who commit egregious wrongdoing in order to protect the public. However, there is noteworthy variability in the extent to which SMBs impose severe disciplinary action. In this manuscript, we present and synthesize a subset of 11 recommendations based on findings from our team’s larger consensus-building project that identified a list of 56 policies and legal provisions SMBs can use to better protect patients from egregious (...) wrongdoing by physicians. In 1988, Colorado instituted a new regulatory system that was opposed by psychologists and social workers. We surveyed 306 psychotherapists about their attitudes regarding this system, which included profession-specific licensing boards and an omnibus board to handle grievances. Social workers and psychologists, members of more established professions, opposed creating an omnibus licensing board and favored the return of profession-specific grievance functions. Members of the newer professions and unlicensed psychotherapists were not as opposed to omnibus boards. All groups agreed in their (...) positive ratings of the performance of the Colorado grievance structure. These results are discussed in terms of "capture" theory, which postulates that professions capture governmental regulation and use it for their own interests. (shrink)
